Terms of Service

1. Acceptance of terms

By accessing or using the ClimberPyramid mobile application and related services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

2. Description of service

ClimberPyramid is a mobile application that helps climbers log ascents, view grade pyramid reports on device, and create private or public route beta notes (including photos, doodles, voice notes, and video links where available). The Service may be updated, modified, or discontinued at any time.

2.1 Public beta catalog

The public beta catalog is a community feature. When you publish a beta note, its content (within the fields you choose to publish) may be visible to other users, who may upvote or comment. You are responsible for what you publish and for complying with applicable laws. You can unpublish when the app provides that option.

2.2 Pyramid reports

Pyramid reports are generated on your device from climbing logs synced to your account. Reports depend on the accuracy and completeness of the logs you enter. We do not guarantee that a report matches any particular training methodology or outdoor conditions.

3. User accounts

3.1 Account creation

To use the Service, you must:

  • Be at least 13 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us promptly of any unauthorized access

3.2 Account responsibility

You are responsible for all activities that occur under your account. You agree to keep your sign-in method secure. We are not liable for loss or damage arising from your failure to protect your account.

4. Acceptable use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Upload malicious code, viruses, or harmful content
  • Attempt unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Use automated systems to access the Service without permission
  • Upload content that infringes intellectual property or privacy rights
  • Harass, threaten, or post abusive content in public comments or published betas
  • Misrepresent route conditions or safety information in a way that could endanger others

5. User content

5.1 Ownership

You retain ownership of climbing logs, beta notes, and other content you upload ("User Content"), subject to the license below.

5.2 License to us

By uploading User Content, you grant us a limited, non-exclusive, royalty-free license to:

  • Store, sync, and display your content to provide the Service
  • Show published beta content to other users in the public catalog
  • Process comments and upvotes on public listings
  • Create backups and technical copies as needed for operation and security

5.3 Content accuracy

You are responsible for the accuracy of information you provide. Grades, locations, and beta descriptions are for personal and community reference only.

6. Climber Pro and purchases

Optional paid features ("Climber Pro") may be offered through the Apple App Store or Google Play. Purchases, renewals, refunds, and cancellations are governed by the applicable store's terms. We do not process payment card data directly.

7. Intellectual property

The Service, including its design, branding, and original features, is owned by ClimberPyramid and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

8. Service availability

We strive to provide reliable service but do not guarantee uninterrupted availability. The Service may be unavailable due to maintenance, technical issues, third-party outages, or events outside our reasonable control. Offline features depend on data already cached on your device.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIMBERPYRAMID SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM:

  • Your use or inability to use the Service
  • Reliance on logs, pyramid reports, or beta notes (including content from other users)
  • Unauthorized access to or use of your account
  • Any conduct or content of third parties

10. Climbing risk disclaimer

CLIMBING AND MOUNTAINEERING ARE INHERENTLY DANGEROUS ACTIVITIES. THE SERVICE IS PROVIDED FOR LOGGING, PLANNING, AND REFERENCE ONLY. IT DOES NOT REPLACE PROFESSIONAL INSTRUCTION, GUIDEBOOKS, LOCAL KNOWLEDGE, OR YOUR OWN JUDGMENT. YOU CLIMB AT YOUR OWN RISK.

11. Warranty disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Indemnification

You agree to indemnify and hold harmless ClimberPyramid and its operator from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, your violation of any third-party rights, or your User Content.

13. Termination

13.1 Termination by you

You may stop using the Service at any time and request account deletion as described on our account deletion page.

13.2 Termination by us

We may suspend or terminate your account if we believe you violated these Terms or if your conduct is harmful to other users, us, or third parties.

13.3 Effect of termination

Upon termination, your right to use the Service ceases. We may delete your account and data subject to our Privacy Policy and legal retention obligations.

14. Changes to terms

We may modify these Terms at any time. We will post updated Terms on this page and update the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms where permitted by law.

15. Governing law

These Terms are governed by the laws of Serbia, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of the courts of Serbia, unless mandatory consumer protection rules in your country require otherwise.

16. Severability

If any provision of these Terms is found unenforceable, that provision shall be limited to the minimum extent necessary, and the remaining provisions remain in full force.

17. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ClimberPyramid regarding the Service.
